Commission Terms
COMMISSION AGREEMENT — DARON FRALEY FINE ART
1. Scope of Work
This agreement covers the creation of one original painting as described in the commission request submitted via daronfraley.org. Subject matter, size, medium (oil or acrylic), and any specific requirements will be confirmed in writing via email before work begins.
2. Pricing & Deposit
The total commission price will be quoted and agreed upon via email before work begins. A non-refundable deposit of 50% is due before any work commences. The remaining 50% is due upon completion and before delivery.
2b. Reference Material
Commissioned works typically require photographic or visual reference. You may provide your own reference photos, provided you own the rights to them or have permission to use them for artistic purposes. I accept no liability for copyright issues arising from reference material provided by the client. If reference material must be sourced or photographed independently, this will be discussed during the quoting process and may affect the final price and timeline.
3. Sketch Approval
Before committing to canvas, I will provide a preliminary sketch or compositional study for your review and approval. Work on the final painting does not begin until you approve the sketch in writing. One sketch revision is included. Additional sketch revisions are $50 each.
4. Timeline
Estimated completion time will be provided with your quote. Timelines are estimates, not guarantees. I will communicate any significant delays promptly.
5. Revisions to Finished Work
One minor revision to the finished painting is included if requested within 7 days of delivery. A minor revision is defined as a small adjustment to color, tone, or detail — not a compositional change. Additional revisions or significant changes are quoted separately.
6. Cancellation
If you cancel after the sketch has been approved and work on the final painting has begun, the 50% deposit is forfeited. If I am unable to complete the commission, your deposit will be refunded in full.
7. Copyright & Reproduction Rights
I retain full copyright of all commissioned works. You receive the right to display the physical painting privately or publicly and to share images of it on personal social media with credit to Daron Fraley. You may not reproduce, print, or sell the image commercially without written permission.
8. Giclee Prints
I reserve the right to offer giclee print reproductions of commissioned works unless you request exclusivity in writing at the time of commission. Exclusivity requests may be accommodated for an additional fee to be quoted separately.
9. Shipping & Delivery
Shipping costs are the responsibility of the buyer and will be added to the final invoice. All paintings are carefully packaged. I am not responsible for damage caused by carriers, but I will assist you in filing a claim if damage occurs.
10. Agreement
Submission of a commission deposit constitutes acceptance of these terms. These terms apply to all commissions placed through daronfraley.org.
